The Court made the following:

Heard Sri Sugali Mahesh Naik, learned counsel representing Sri Rayalcheruvu Abishek Reddy, learned counsel for the petitioners, learned Government Pleader for Endowments appearing for respondent^Nos.1 to 5 and Ms. Devi Subhashini Anne, learned Standing Counsel appearing for respondent No.6. With the consent of both the learned counsel, the writ petition is disposed of, at the stage of admission.

The grievance of the petitioners is that the respondents, without issuing any prior notice or considering the petitioners’ representation are proposing to evict the petitioners from the subject shops which^{havebeentakenonlease} by the petitioners.

It is contended that initially, a notice dated 21.11.2024 under Section 83(2) of the Andhra Pradesh Charitable and Hindu Religious^{Institutionsand} Endowments Act, 1987 (hereinafter referred to as ‘the Act, 1987’) was issued to the petitioner to show cause as to why they should^{notbeevictedfromthe} premises.

To the said notice, it is contended that the petitioners^submitted an explanation to the 6*'^ respondent. Despite this, the 6^*^ respondent passed an order of eviction on 07.12.2024, alleging that the petitioners are liable to pay the damages to a tune of Rs.5,500/-, in addition to^the same it was observed that the lease rentals that were paid by the petitioners^{areatnominalrateof}

Rs.500/whereas the same would fetch Rs.2,500/thus directed the petitioners to vacate the shops, failing which, the petitioners would be forcibly evicted. Subsequently, when the respondents have proposed to conduct a fresh auction of the subject shops. The petitioners submitted a representation dated 11.07.2025 to the 6^^ respondent requesting for extension of the lease.

Ms. Devi Subhashini Anne, learned Standing Counsel appearing for respondent No.6, submitted that despite the order of eviction, the petitioners have not vacated the premises nor paid the outstanding rentals to respondent No.6. Therefore, their request for extension of the lease would not be justifiable.

Having regard to the submissions made, this Court deems it appropriate to dispose of the writ petition with a direction to the 6^^ respondent to allow the petitioners to continue occupation of the subject shops^till an auction notice for auction of the leasehold rights in respect of the subject shops is issued. Till such time, the respondents are directed not to dispossess the petitioners, subject to the condition that the petitioners clear all the outstanding arrears of lease rent, including any other dues pending, within a period of two weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
