This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. aggrieved by the order dated 30.01.2009 passed by the learned I Additional Judicial I Class Magistrate Proddatur, in Crl.M.P.No.1921 of 2007 in M.C.No.6 of 2004.

Heard. Perused the record.

A perusal of the report received from the Secretary-cum-Civil Judge (Senior Division), District Legal Services Authority, Kadapa, shows that whereabouts of the petitioner are not traced out in spite of their best efforts. Since the petitioner has not been showing interest to prosecute the case and notice has not been served on the revision petitioner, this Court is inclined to dismiss the Criminal Revision Petition for default.
