The CrI-minal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioners rierein/Accused Nos.2 to 5 to grant anticipatory bail in connection with Crime No.140 of 2025 of Rayachoty Police Station, Annamayya District.

A case has been registered against the petitioners hereI'n and others for the offences -punishable under Sections 189(2), 191(2),191-(3),1321109,196, 351(2) and 61(2) read with 190 of the BNS.

Brief facts of the case are that, on o4.03.2025, as per the orders of the superior officers, the defacto comp]ainant while monitoring the Veerabhadra Swamy Brahmotsavam in Rayachoti Town, and while going with the procession, Veerabhadra Swamy vehicle came {o Tana junction, and while standing there, the procession was joined by people belonging == ==

It is alleged that even though the Endowments department officials suggested to say Jai Mahadev and it was Adisaiva Mahotsavam, Anand Gajapathi Raju, the group of about 200 people from Rayachoti town, did not listen to them and stopped the procession of Godls idol near Tana Junction Mosque, staring at Muslims and provoking Muslims by "Jaishree Ram, go to Pakistan", while some Muslims also provoked Hindus saying that llyou have to go the same way again, be careful we wI'll attack" and ran away. Thereafter, at around ,06.15 p.m. there-was a tense situation due to the incitement of Syed Sharfuddin, a religious leader of the Muslims in Tana Junction, slowed down the procession. Then, the accused provoked the-youth around them to throw thousands of stones at the Ayesha Masjid near Ravl- Hall, chanting slogans of Jaishree ram, Pakistan down and took stones from the mosque and surrounding roads and threw them on the houses. when the defacto complainant tried to stop them, they allegedly Pushed him down and Put their feet On his throat, tried to trample and kill him.

Heard. Perus'ed the record.

Learned counsel for the .petitioners submits that the petitl'oners herein were falsely implicated I'n the Present Crime and prays this court to grant anticipatory bail. to the petitioners herein.

6.!' On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of anticipatory bail to the petitioners herein.

RE RE

A perusal of the material on record goes to shOWthat On the same day'a case in crime No.139 of 2025 has been registered, based on a report lodged by the Reserve Inspector of police. lt seems that procession of Veerabhadra Swamy _Brahmotsavam was reached Tana Junction and some Muslim people gathered there and shouted and threatened to kill. Though several persons have been implicated in both the crimes and the material on r-ecord indicates that three Persons Were injured in the present crime. lt is submitted by the learned Assistant lPublic Prosecutor that the injured Persons Were sustained simple inJ-urieS and they Were discharged from the hospital on the same day. The allegations made against I-he petitioners do not fit to the injuries sustained by the three injured persons. It seems that an attempt has been made tO implicate as many as people due to religious differences. It is submitted by the learned counsel for the petitioners that the petitioners herein have permanent abode and there is no poss-lbility of their fleeing away from the justice. lt is Submitted by the learned Assistant Public Prosecutor that the petitioners herein haV,e nO previous crime record.

In view of the aforesaid facts and Circumstances, this court is inclined to grant anticipatory bail to the petitioners herein on the following conditions.

i) The petitioners herein are directed tO Surrender before the station House Officer, concerned, within a Period Of two (2) weeks from the date of receipt Of a COPY Of this Order. on such surrender, petitioners herein are ordered to be enlarged on bail on their executing a personal bond for Rs.25,000/-

ii) On release, the petitioners herein shall appear before the Station House Officer, concerned, once in a week i.e., on every Sunday between 10.00 AM and O1.00 PM for a period of two (2) months.

iii) The petitioners herein shall make themselves available for investigation as and when required and that they shall not cause any threat, inducement or promise to 'the prosecution witnesses.

Accordingly, the Criminal Petition is allowed.

Consequently, miscellaneous applications pending, if any, shall stand closed.
