Her elder son begot one male and one female child, her grand daughter js mentally dISable, as such, she used to look after hI'S needs I-n the house when her famI-Iy members are engaged jn farml'ng works. About five days back, when she was engaged jn house keepI-ng works, at that time accused approached vI'CtI'm, took her into his house by chltchattlng wlth her, later on her suspICIOn She vl-sjted house of accused, wltnessed accused touchlng upon the whole body of her grand daughter ln Obscene manner, she ,Informed the same to her family members and elders. As the elders falls to settle the I-ssue at village level as accused did not respond, she gave report to pollce. Basing on the report of the defacto complainant, thI®S Crlme was registered and during the course of I-nVeStl'gatl-on, arrested the petjtI'Oner/accused on 20.01.2025 and got remanded to judl'cI-aI Custody.

Heard srI' S.Syam sunder Rao, learned counsel for the petl-tioner and sri Neelothpal Ganjj, learned Assistant public Prosecutor for respondent. 5. Learned counsel for the petl'tl'oner would subm,-t that the pet,-tioner has been ln JUdl'CI'al custody sl'nce 20.01.2025. Petl-tioner js innocent of the offence and he js ready to furnish solvent suretI-eS tO the satisfactIOn of the

court. It is further Submitted that Charge Sheet Was filed in this matter and prays to allow the criminal petition and grant bail to the petitioner.

Contra tO the Same, learned Ass'lstant Public Prosecutor WOuld submit that in this case RFSL report, WOund Cert-IfiCate and POtenCy test report was received. He further Submitted that the Victim 'lS a mentally challenged person and preliminary charge sheet in this case was filed on o2.02.2025 and vehemently opposed tO allow the Petition. He further would submit that section 164 Cr.P.C. statement Of the Victim Was recorded in this case.

Considering the SubmiSS-,OnS made and On Perusal of the material On record and in the light of the peculiar'lty of the present case that the victim is a mentally challenged person. As submitted by the learned Assistant public prosecutor that 'lnvestigation -ln this case is completed and state received wound certificate, RFSL report, the queSt'lOn Of Pet'It-lOner/accused interfering w'Ith the inVeSt®lgatiOn does not arise. In that View, this Court is inclined to release the petit-loner on bail w'lth the following conditions.
