Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A3 to grant regular bail in connection with Crime No.41/2024 of Munchingput Police Station, Alluri Sitharamaraju District.

for the offences punishable u/Sec.20(b)(ii)(C), 25 r/w 8(c) of NDPS Act.

The case of the prosecution in nut shell is as follows:

On 26.10.2024 at 4.00 pm, on receipt of credible information about

illegal possession and transportation of ganja, the Sub-Inspector of Police, Munchingiput Police Station, along with staff and mediators went to Labburu Village junction, Jolapur Panchayat and conducted vehicle checking. Police found one motorcycle bearing registration no.OD 18 K 0139 coming from Barada side towards checking place. On seeing police, the rider and the pillion rider of the motorcycle tried to escape by reversing the motorcycle. Then police apprehended them and on enquiry, they disclosed their identity particulars as that of A1 and A2 and police found 100 kgs of ganja in their possession. Police arrested the accused, seized the contraband and vehicle. Basing on their confession statement, the petitioner/A3 was arrested on 26.10.2024.

Heard Sri K.Pridhvi Raju, learned counsel for the petitioner/A3 and Sri Neelothpal Ganji, learned Assistant Public Prosecutor for the respondent.

Learned counsel for the petitioner would submit that the petitioner has been in judicial custody from 26.10.2024 and more than four months elapsed and prays to allow the criminal petition.

Contra to the same, learned Assistant Public Prosecutor vehemently opposed the petition stating that inventory is pending in this matter and the seized contraband is huge quantity and if he was enlarged on bail he would repeat the same offence and prays to dismiss the criminal petition.

Considering the submissions made and on perusal of the material on record shows that learned Assistant Public Prosecutor has rightly pointed out that the seized contraband is huge quantity and as the investigation is pending, this Court is not inclined to grant bail to the petitioner at this stage.
