THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO CONTEMPT CASE No.459 of 2025

ORDER:

This Court, vide order dated 05.03.2024, disposed of the W.P.No.5739 of 2024, directing respondent Nos.2 and 3 therein to examine the representation dated 09.09.2022 and pass appropriate orders in accordance with law, and communicate the same to the petitioners, within a period of three months from the date of receipt of a copy of the order. For non-compliance of the said order, present contempt case has been filed.

Precisely, representation is submitted for payment of Solatium on the enhanced compensation and interest amount on the Additional Market Value.

The 2^nd respondent-Special Deputy Collector (LA) (FAC), TGP Unit-II, Kadapa, vide proceedings dated 01.03.2025, disposed of the representation by relying on orders passed in W.P.Nos.23443 and 23447 of 2010, and suggested the petitioners to file Execution Petition before the competent civil Court.

Learned counsel for petitioners requested that a similar order be passed as in C.C.No.451 of 2025, wherein the learned Single Judge of this Court, while closing the contempt case, granted liberty to the petitioners therein to file an Execution Petition before the competent civil Court.

The Hon’ble Apex Court in R.N.Dey and others v. Bhagyabati Pramanik

and others¹ held that proper forum to execute the award is competent civil Court.

Therefore, the present Contempt Case is closed granting liberty to petitioners to approach competent Civil Court for execution of the award.

Consequently, Miscellaneous Petitions, if any, pending in the contempt case shall stand closed.
