This Writ Petition is filed under Article 226 of the

Constitution of India seeking the following relief;

…to issue a Writ, order or direction especially one in the nature of Writ of Mandamus declaring the inaction of the 2nd respondent not to consider the petitioner representation dated 23.02.2024 according to law as illegal, arbitrary, violative of Articles 14 19 and 21 of the Constitution of India and pass… ”

Grievance of the petitioner is that his cousin by

name P. Santhamma had taken the house bearing D.No.3-1-61 situated at Vidyanagar Colony, Tirupati Rural Mandal on monthly rent of Rs.10,000/- from one P.G.N.P. Srinivas. On request of P.G.N.P. Srinivas/the owner of the premises, the petitioner’s cousin spent huge amount for repairs of the said premises. After completion of the repairing work, P.G.N.P. Srinivas used to postpone the payment of the amount spent by the cousin of the petitioner on some pretext or the other. But, surprisingly the owner of the premises demanded the cousin of the petitioner to vacate the schedule property. On that the cousin of the petitioner filed O.S.No.531 of 2023 on the file

of the Principal Junior Civil Judge, Tirupathi, during

pendency of the said suit, she obtained ad-interim injunction in I.A.No.203 of 2023 in her favour restraining the respondent therein from interfering with her peaceful possession and enjoyment over the petition schedule property and the said orders are being extended from time to time. Despite order in I.A.No.203 of 2023, the owner of the property and his wife are trespassing into the premises and threatening the cousin of the petitioner with dire consequences. On that the petitioner made representation on 23.2.2024 to the respondent No.2 for taking necessary action.

Though the representation was submitted by the petitioner on 23.2.2024, till today, the respondent/police have not passed any orders.

In view of the facts and circumstances of the case, the respondent/police are directed to pass orders in accordance with law on the representation dated 23.2.2024 submitted by the petitioner within a period of two (2) weeks from the date of receipt of this order.

With the above direction, this Writ Petition is disposed of.

Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
