cents in Sy No.1/1C (total extent Ac 1.78 cents) situated in Advavivaram Village, Visakhapatnam District by virtue of two registered documents dated 20.09.1982. it is stated that Adavivaram was notified as an Inam village under the provisions of A.P (Andhra Area) Inams (Abolition and conversion into Ryotwari) Act 1956. Fresh Survey and Settlement operations have not been conducted after coming into force the Inams Abolition Act and no notices have been issued either to the petitioner or to its predecessors in title under the provisions of the Inams Abolition Act. Further the land situated in Sy.Nos.1/1B and 1/1C of Adavivaram Village is classified as “Zeroyati” in the survey and Settlement Register. The land in question is not shown as “Inam “ in the said register. The Expression “Zyroiti” clearly shows that the land in question is not Inam land and that it was not endowed in favour of the temple by the Zamindar. Even though the 2nd respondent temple having no manner of claim over the lands, the 2nd respondent temple authorities have started the exercise of erecting a fence around the property of the petitioner since 29.11.2015 and planted concrete poles with the letters “SVLNSD” embossed thereupon, with an intention to prevent ingress and aggress to the petitioner’s land. If the 2nd respondent Devasthanam has any claim over the property, it has to establish the same first, in properly constituted proceedings, before the appropriate forum and only thereafter seek to take possession.
