possessors of the residential land in an extent of 220 sq.yds of in Survey No. 147/P - Plot No.64 (of the 1st Petitioner), an extent of220 Sq.yds of land in Survey No.147/P – Plot No.63 (of the 2nd petitioner) an extent of 220 sq. yds of land in Survey No.136/1 – Plot No.56 (of the 3rd petitioner) and an extent of 220 sq. yds each of land in Survey Nos.84/1B, 136/1 and 162/1&2 – Plot Nos.65, 156 and 157 (of the 4th petitioner) situated in Venkatapuram Village, Pendurhi situdal, Visakhapatnam District, covered by D- Block. The petitioners' predecessors-intitle had purchased the same under different registered sale deeds, one being Document No. 1580 of 1978, dated 27.03.1978. In the Survey and Settlement Register (Gillman Register), the land in Survey No.147 of Adavivaram Village shown as "Inam". The name of the Inamdar/Pattadar is shown as Kirlampalli Venkanna and Sathi Raju. In relation to Survey No. 167/1&2, the same names are shown, along with the names of Mudapaka Adenna. Insofar as Sy.No.136/1 and 84/1B are concerned, the names are shown as Pedapudi Narsigadu and Appalaswamy. The lands are not shown to be endowed or granted in favour of the 2nd respondent temple. Even though the 2nd respondent temple having no claim over the subject lands, they are frequently interfering with the peaceful possession and enjoyment of petitioners' property, without following due process of law. Further, no notice was issued and no opportunity was given to the petitioners to put-forth their case.
