It is submitted that, one of the Respondents is no^more and that one of the Respondents has retired and he is receiving his pension.

The Petitioners are the Zilla Panchayat and the 3) Panchayat Raj Department, who are before this Court being aggrieved by the Orders passed by the Tribunal in O.A. No.7902 of 1997 and O.A. No. 7808 of 1998, whereby^the Tribunal acting on the O.A’s, preferred by the private Respondents was pleased to set-aside the impugned G.Os., and further grant certain other directions too.

The Writ Petitions have been pending for the last 4) eighteen [18] years and despite the matters being listed on two occasions, there being no representation on behalf^ofthe would have been inclined to direct private Respondents, we the impleadtnent of the legal heirs of the deceased^private Respondent, but we dispense with the same in view of^thefact that the issues involved stands determined by decisions^ofthe HonT)le Apex Court.

The issue that was raised was one of restricting the 5) rOgularization from the date of G.O. Ms. No. 212, dated 22.04.1994, and not from the date of appointment. This^issue came to be agitated before this Court and later was taken^up before the Apex Court and the Apex Court in Manjula Bhashini and Others Vs. Managing Director, Andhra Pradesh Women^s Cdoperative Finance Corporation Limited and Another^ has settled the issue and the same has attained finality.

In that view, the question of entitlement of persons regularized under the 1994 G.O. from an date anterior to the date of G.O. dated 23.11.1994 has been rejected by the Honhle Apex Court and the Apex Court has in the ruling noted supra has been pleased to* settle the issue by upholding the G.O. issued in 1998 by holding that the regularization can only be prospective from the date, of G.O. i.e.^23.11.1994. In that view, the issue regarding retrospective regularization stands decided and the Writ Petition in so-far-as it relates to issue of retrospective regularization or regularization^froma date anterior to the G.O. Ms. No. 212, dated 22.04.1994, stands decided in terms of the law laid down by the^{Hon^ble} Apex Court in Manjula Bhashini case.

In so-far-as consequential proceedings initiated to recover the alleged excess amount, the answers are^notfarto. seek and the Respondents having retired or otherwise having passed away, the question of effecting recovery would not arise as admittedly the Respondents are employees in ministerial category or equivalent to Group-Ill cadre.
