Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus: (i) to declare the decision of the first respondent Society in proposing to hold enquiry afterretirement of the petitioner from service without paying terminal benefits viz., provident fund, leave encashment, gratuity etc., and arrears of salaryfrom the date of suspension i.e. 19.08.2007 through proceedings 30.12.2009 and prior to the suspension period for which he has worked from 01.08.2006to18.08.2007 as illegal, arbitrary, unjust apart from violative of principles of natural justice and against the powers vested in the first respondent; and (ii) to consequently set aside the proposal of the first respondent to hold enquiry after his retirement through proceedings dated 30.12.2009 by directing the respondents to pay the arrears of salary to him from 01.08.2006 to 18.08.2007 and salary for the period of suspensionfrom 19.08.2007 till retirement i.e. 31.01.2010 and the terminal benefits such as provident fund, gratuity, leave encashment along with interest at 12% p.a. from the date of outstanding due.
