The present Criminal Petition came to be filed underSection482 of Cr.P.C., seeking to quash the proceedings in Cr.No.150 of 2017, on
the file of the Dharmajaigudem Police Station.
- Heard Sri V.N.V.Surya Datta, learned counsel representingSmt. Nimmagadda Revathi, learned counsel for the petitioner, learned Assistant Public Prosecutor appearing for the respondent No.1 and Sri Naram Nageshwara Rao, learned counsel appearing for the respondent No.2 and perused the material on record.
- Today, when the matter came up for hearing, learned Public Prosecutor has furnished a copy of instructions issued by the SubInspector of Police, Dharmajigudem Police Station,where in it is stated that after due investigation the case was already chargedon06.12.2020 and the same was numbered as C.C.No.230 of 2018 and presently the case is for PT. In view of the same, learned counsel for the petitioner has sought permission of this Court to withdraw the present Criminal Petition with a liberty to challenge the said chargesheet.
- Accordingly, the Criminal Petition is dismissed as withdrawn by granting liberty to the petitioner to challenge the charge sheet, if at all he is aggrieved by the same. There shall be no order astocosts.
