- The writ petition is filed to declare the action of the 2"^ respondent in trying to cause damage to the road to Kandepu Donka road measuring an extent of Ac.0.023/4 cents in Sy.No.239-lA which is meant for ingress and egressandalso transportation of agricultural .prgfipces as illegal and arbitrary.
“In the meantime, respondem,No.2 or its officials shall not damage the road called as ‘Kandepu Donka road measuring an extent of Ac. 0.02 % cents in survey N0.239-1A, Ponnur Town and Mandal, Guntur District and petitioner shall neither repair the road nor layroad any further”
- Complaining the violation of the said order, the above
contempt case is filed.

the said Nageswara Rao to cause damage to the roadandflouted the orders of this Court.
- The respondent filed reply to affidavit. It was statedthat the petitioner suppressed the Surveyor’s report. Asper the report of Deputy Inspector of Survey, an extent ofAc.87-72 cents in Sy.No.239-1A helongs to Sri BhavannarayanaSwamy temple and there is no cart track as per the plan.Thepetitioner
never cultivated the land, and the land is kept vacant forthelast six years. The petitioner, in fact, filed applicationforconversion of the agricultural land to non-agricultural land andpermission
was granted vide D.Dis.No.32/2023-C dated 07.01.2023. Itwas further contended that the order dated 27.01.2023 is not violated.
- The grievance of the petitioner in the writ petitionisthat the Executive Officer of the Temple is intending tocausedamage the road and hence, the interim order was passed directingthe Executive Officer of the Temple not to cause damage. It was further observed that the petitioner also shall notrepairthe road. In the affidavit filed in support of the contempt, it was averred that one Sri K. Sai Nageswara Rao, vendor of the

petitioner, removed the road more than 20 ft and erectedthe poles.
- In view of the same, this Court does not find any violation of the orders passed by the contemnor-respondent.
- Accordingly, the Contempt Case is closed. There shallbe
no order as to costs.
As a sequel, pending miscellaneous petitions, if any,shall
stand dismissed.
