This appeal is filed assailing the judgment and decree dated 27.2.2018, passed in O.S.No.194 of 2013 on the file of the Court of the IV Additional District Judge, Guntur, by virtue of which the lower Court decreed the suit filed by the sole respondent/plaintiff for specific performance of agreement of sale dated 02.11.2006. During the pendency of the appeal, the sole respondent died and his Legal Representatives are brought on record, as per the order dated 12.11.2024 in I.A. No.1 of 2019, as respondent Nos.2^to4.

This application is filed by the appellants and respondent^Nos.2to 4 seeking to record the compromise entered into between the parties. 3. Heard the learned counsel for the petitioners/appellants, Also hearpi the learned counsel for the respondent Nos.2^to4.

The appellants as well as respondent Nos.2 to 4, who are identified by their respective counsel, are present before this Court and on being specifically asked, both the parties confirm the terms of compromise recorded in the joint memorandum of compromise dated 09.10.2024 appended to the application. As the parties voluntarily agreed to settle the dispute amicably and the terms and conditions are reduced into writing by way of a joint memo, this Court is inclined to record the terms of compromise, and accordingly I.A. No.1 of 2024 is allowed.

It submitted that the husband of the 2"'^ Appellant, father of the respondents No.3 and 4, who is the 1®‘ respondent in the above appeal suit filed O.S.No.194 of 2013, on the file of the Court of the VI Additional District Judge, Guntur, seeking for specific performance of the agreement of sale dated 02-11-2006, executed by the Appellants

of an amount of Rs.2,02,44,666/- with an interest @ 24% per annum. The Appellants have contested the above suit, stating^thatthetime stipulated in the agreement had already lapsed and after long lapse of time, the suit filed with a 'malafide intention^{andalsostatedthatthe} Plaintiff/Respondent No.1 herein had no capacity to pay the balance sale consideration. After completion of the trial the^{Hon’bleTrialCourt} was pleased to decree the suit with costs by a judgment^anddecree dated 27-03-2018. Aggrieved by the above said judgment and decree, the Appellants filed the above A.S.No.643 of^{2018beforethis} Hon’ble Court.

It is submitted that while the above appeal was pending^before this Hon’ble Court, the husband of the 2^^ respondent^andthefather of the respondents No.3 and 4 herein, who is the Respondent^No.1 herein died on 30-05-2019, leaving behind him the 2'^'^ respondent and the Respondents No.3 and 4 herein. Thereafter the appellants filed an interlocutory application seeking to bring the Respondents No.2 to 4, as the legal representatives of the 1®* respondent herein.
