This writ petition is filed to declare the inaction of the respondents in placing the petitioners in the top of the seniority list against those who got old station points along with reapportionment/rationalization points by applying G.O.Ms.No.187 dated 10.12.2022 for the proposed transfers of the petitioners, as illegal and arbitrary.

Heard learned counsel for the petitioners and learned Government Pleader for Services-III appearing for the respondents.

According to the petitioners, they have been working as Secondary Grade Teachers in various schools under Mandal Praja Parishad Schools in Krishna District and they have successfully completed eight years of service in their respective schools. While so, the 1^st respondent issued G.O.Ms.No.190, School Education Department, dated 21.12.2022, giving clarification to Guideline No.8 in note 3 of G.O.Ms.No.187 dated 10.12.2022 to the effect

that the Head Masters (GR.II)/Teachers who have availed the

preferential category or special points in Transfers 2020 are now effected under re-apportionment without completion of 5/8 academic years of service respectively shall be given old station points along with re-apportionment points. The grievance of the petitioners is that in view of G.O.Ms.No.190 dated 21.12.2022, they are next to the Teachers/Head Masters who are getting old station points and rationalization/reapportionment points in the seniority list for the present general transfers and thereby, they will have to go to corner/remote/long distance places. In this regard, they submitted a representation dated 31.12.2022 to the 3^rd respondent through e-mail bringing to his notice the above disparities. But so far, no action is initiated by the 3^rd respondent.

Learned Government Pleader for Services-III submits that the 3^rd respondent did not receive any representation from the petitioners.

Having regard to the submissions made by the learned counsel for the petitioners as well as learned Government Pleader and in the facts and circumstances of the case, this Court deems it

appropriate to dispose of the writ petition with a direction to the 3^rd respondent to consider the representation of the petitioners.

Accordingly, the Writ Petition is disposed of directing the 3^rd respondent to dispose of the representation of the petitioners dated 31.12.2022 and pass appropriate orders thereon, within one week from today or before effecting the transfers in respect of the petitioners whichever is earlier. The petitioners are instructed to submit another representation to the 3^rd respondent by approaching him personally, by 03.01.2023 itself. No order as to costs.
