ORDER:

The petitioners claiming to be in possession and enjoyment of open land covered by S.S.No.6 (present Sy.No.213) in Kapu Street, Yerpedu Village and Mandal, Chittoor District have approached this Court with a grievance that the official of the Gram Panchayat were seeking to interfere with the possession of the petitioners over the said land illegally and without following any procedure.

The official respondents 1 & 3 have filed their counter affidavit stating that the land is already in their possession and that the question of illegal eviction of the petitioners does not arise.

Sri P. Ganga Rami Reddy, learned counsel for the petitioners would submit that there has been a long line of civil litigation between the petitioners and one Sri. M. Ramachandraiah including A.S.No.1459 of 2003 which is still pending before this Court. He would submit that the said proceedings would amply demonstrate the possession of the petitioners over the subject land.

It would not be appropriate for this Court,

exercising Writ Jurisdiction, to go into the questions of fact and as such, it would be appropriate to dispose of this Writ Petition with a direction to the respondents not to take any coercive steps against the petitioners, if they are in possession of the said land, except in accordance with law.

The question of whether the petitioners are in possession or not will in any event be decided in A.S.No.1459 of 2003 and appropriate steps should be taken in accordance with the said Judgment that may be delivered upon the disposal of the said appeal.

Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
