Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the Action of the 4 , 5th and 6th respondents there by sending Panel of Advocates for the post of Additional Public Prosecutor pertaining to the III Additional District Court Rajampet, YSR Kadapa District, Pursuant to the Notification, Dated 24.11.2021 issued by the 6th respondent without Considering the application of the Petitioner and including the name of the Advocate in the Panel who submitted application at Later Date on 29.11.2021 and without following the procedure as per the G.O. MS No. 187, Law, dated 06-122000 and Section 24 of Cr.P.C. as illegal, irregular, and offends of Article 14, 16,

21 of Constitution of India and Set aside the Panel sent by the 4th, 5th and 6th respondents for the post of Additional Public Prosecutor pertaining to the III Additional District Court Rajampet, YSR Kadapa District, Pursuant to the Notification, Dated 24.11.2021 issued by the 6th respondent and consequently direct the Respondents to prepare the Fresh Panel of Advocates by considering the application of the Petitioner for the post of Additional Public Prosecutor pertaining to the III Additional District Court Rajampet, YSR Kadapa District.

This writ petition is filed to declare the action of

respondent Nos.4 to 6 in sending Panel of Advocates for the post of Additional Public Prosecutor pertaining to III Additional District Court, Rajampet, YSR Kadapa District, pursuant to notification, dated 24.11.2021 issued by respondent No.6, without considering the application of the petitioner and

including the name of the Advocate, who submitted letter on a later date i.e. on 29.11.2021, as illegal and irregular.

Today, when the matter is listed, Sri Mattegunta Sudhir, learned counsel for the petitioner submitted that pending the writ petition, Md. Nizam Jani, Advocate was appointed as Additional Public Prosecutor for a period of three years, vide G.O.Rt.No.391 dated 17.05.2022. Therefore, nothing survives for

adjudication in this writ petition.

Recording the above submission of learned counsel for the petitioner, this writ petition is dismissed as infructuous. No costs.

As a sequel, pending miscellaneous petitions, if any, shall stand dismissed.
