ORDER:

The present writ petition came to be filed under Article 226 of

the Constitution of India seeking the following relief:

“…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus by declaring the action of the Respondents No.4 and 5 that interfering in the petitioner’s peaceful possession and enjoyment of the agricultural land in survey no.23 to an extent of Ac.1.02 cents situated in Vepurikota Village, Molakala Cheruvu Mandal, Chittoor District, on the guise that the government planning to lay a road, without acquiring the land and without following due procedure of law, is illegal, arbitrary, unconstitutional, against the principles of natural justice and against the provisions and spirit of Land Acquisition Act and consequently direct the Respondent No.2 to 5 to follow due procedure of law …”

When the matter came up for admission on 10.02.2020,

this Court was pleased to grant interim order as follows:

“ …the respondent Nos.2 to 5 are directed not to interfere with the petitioner’s peaceful possession and enjoyment of the agricultural land in Survey No.23 to an extent of Ac.1.02 cents situated in Vepurikota Village, Molakala Cheruvu Mandal, Chittoor District without following due procedure of law…”

Today, when the matter came up for hearing, learned counsel for the petitioner reiterated the contents urged in the present writ petition.

On the other hand, learned Government Pleader for Revenue, on oral instructions had submitted that, if at all the respondents intend to interfere with the peaceful possession of the

petitioner of the subject property, they would follow due procedure of law.

In view of the above, this Court feels it appropriate to dispose of this Writ Petition by directing the respondent authorities not to interfere with the peaceful possession and enjoyment of the petitioner of the agricultural land in Survey No.23 to an extent of Ac.1.02 cents situated in Vepurikota Village, Molakala Cheruvu Mandal, Chittoor District, without following due process of law.

Accordingly, with the above direction this writ petition is disposed of. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, shall

stand closed.
