The present Writ Petition is filed by the petitioners under Article

226 of the Constitution of India, seeking the following relief:

“………to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the respondents in noncompliance of pending due MGNREGS Convergence Funds of Rs.8,49,836/- in connection with M.Book No.124-A for providing Hand Pumps in Mudunuru Grama Panchayat in the year 2021 pursuant to the Mahatma Gandhi National Rural Employment Scheme (MGNREGS) grants towards cost for the material supplied by the petitioner under MGNREGS in Convergence despite issuing Pass orders in M.Book No.124-A and keeping bills pending from the year 2021 as illegal, arbitrary, violation of principles of natural justice contrary to the Rules and Regulations of the National Rural Employment Guarantee Act, 2005 as contrary to the Settled principles of natural justice and further, offends Article14, 19 of the Indian Constitution and consequently direct the respondents to comply with the above Measurement Books/Fund Transfer Orders by paying amounts along with interests at 18 % to the petitioner and to pass…..”

Heard Sri V.N.V. Surya Dattu, learned counsel for the petitioner, Sri N. Srihari, learned Standing Counsel and learned Assistant Government Pleaders for Panchayat Raj and Finance &Planning Department.

Sri N. Srihari, learned Standing Counsel, based on the written instructions dated 14.09.2023, submitted that, the Gram Panchayat is ready and willing to pay the amount claimed by the petitioner and are

waiting for fund clearance and it will be cleared in due course and sought eight (08) weeks time for such payment.

To the said submission, learned counsel for the petitioner requested to record the written instructions and dispose of the Writ Petition.

Taking into consideration the submissions of both the learned

counsel, as the authorities are ready and willing to pay the legally entitled amount, this Court is inclined to dispose of the Writ Petition with the following direction:

Accordingly, the respondents are directed to release the admitted/legally entitled amount to the petitioner at the earliest, and at any rate, within a period of eight (08) weeks from the date of receipt of a copy of this order.

However, with regard to interest is concerned the petitioner is

at liberty to approach appropriate forum, if so advised.

¶17

There shall be no orders as to costs.

¶18

Miscellaneous applications, pending if any, shall stand closed.
