JUDGMENT:
When the matter was called on 12.09.2023, there was no representation on behalf of the appellant. Even though the matter is listed today under the caption “for dismissal”, there is no representation on behalf of the appellant.
Learned counsel for the respondents represented that the question of law is involved in the order passed by the Tribunal. No cross objections or no appeal filed by the respondents to challenge the said award passed by the Tribunal.
Since the appellant is not inclined to prosecute the case, the appeal is dismissed for non-prosecution. No costs.
As a sequel, miscellaneous petitions, if any pending, shall stand closed.
