These Writ Petitions are filed under Article 226 of the Constitution of India declaring the inaction of the respondent not to count the petitioners ad hoc service from their respective initial appointment, till the date of regularization not to including with the petitioners regular service for the sake of seniority as illegal and arbitrary. Consequently direct the respondents to count the petitioners ad hoc service from their respective initial appointment, till the date of their regularization along with the regular service for the sake of seniority with all consequential benefits, increments, retirement benefits and other monetary benefits.

Heard both the counsel.

It is contended by the learned counsel for the petitioners that the petitioners are seeking only notional benefits from the Ad hoc services of the petitioners for pension purposes. But the same has not been placed before the respondent authorities, which fact is admitted by learned counsel for the petitioners.

Considering the facts and circumstances of the case, this Court, without touching the merits of the case, directed the petitioners to submit fresh representation to the respondent for claiming notional benefits from the ad-hoc services from their respective initial appointments for the purpose of their pension benefits respectively within a period of three (03) weeks from the

date of receipt of a copy of this order. On receiving the representations by the petitioners, the respondent is directed to dispose of the same in accordance with law, within eight (08) weeks thereafter.

With the above direction, the Writ Petition is disposed of. No costs.

As a sequel, miscellaneous petitions pending consideration if any in the writ petition shall stand closed.
