ORDER:

The petitioner states that he had obtained a mortgage deed dated 03.02.2021 from the 5^th respondent as security for repayment of certain money due to him. Thereafter, the 5^th respondent is said to have influenced respondents 3 and 4 to intervene on his behalf. It is the further complaint of the petitioner that respondents 3 and 4, at the behest of the 5^th respondent have been coercing the petitioner to hand over the deed of mortgage back to the 5^th respondent and to give up his claims for recovery of his money. Aggrieved by the said high-handed illegal action by respondents 3 and 4, the petitioner has approached this Court by way of the present writ petition.

The 4^th respondent has filed a counter affidavit. In this counter affidavit, it is stated that the 5^th respondent had filed a complaint dated 22.08.2022 before the 4^th respondent. After receipt of the complaint the 4^th respondent had summoned the petitioner for enquiry. Initially, the petitioner did not turn up for enquiry, despite being called on 22.08.2022. Later, the petitioner appeared before the 4^th respondent on 27.08.2022. After enquiry, the 4^th respondent having realized that the dispute is a civil dispute, had advised both sides to approach the civil Court for redressal and had not summoned the petitioner thereafter.

Recording the above submissions, this writ petition is

disposed of leaving it open to the petitioner to approach this Court in the event of any future difficulties. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
