ORDER:-

This Writ Petition for mandamus is filed to declare the action of the 5^th respondent – Station House Officer of Martur Police Station, Bapatla District, in insisting the petitioner to agree for settlement of terms with the 6^th respondent in connection with a civil dispute, as illegal and arbitrary and consequently sought direction to respondents not to interfere with the personal liberty of the petitioner and in the civil dispute between the petitioner and the 6^th respondent.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on instructions, would submit that the 6^th respondent lodged a report with the 2^nd respondent – Superintendent of Police in Spandana program alleging that the petitioner has cheated his daughter with a false promise to marry her and he got her photographs taken and got them morphed and has been blackmailing his daughter and the 2^nd respondent – Superintendent of Police has forwarded the said report to the 3^rd respondent – Deputy Superintendent of Police, Chirala, for inquiry and therefore, the police are only making an inquiry regarding the allegations made against the petitioner on the report lodged by the 6^th respondent. He would submit that the petitioner has suppressed the said fact and filed this false Writ Petition to prevent the police from taking any action against him. He would submit that there are no civil disputes

between the petitioner and the 6^th respondent and the allegations made to that effect in the Writ Petition are absolutely false.

Learned Assistant Government Pleader for Home has also placed on record the copy of the report lodged by the 6^th respondent against the petitioner along with the proceedings forwarded by the Superintendent of Police in Spandana program.

To a pointed question, learned counsel for the petitioner would submit that there are no civil disputes between the petitioner and the 6^th respondent and it is mentioned by mistake in the Writ Petition that there are civil disputes between the petitioner and the 6^th respondent.

Thus, from the submissions made by learned Assistant Government Pleader for Home and the material placed by him on record and the submissions made by learned counsel for the petitioner that there are no civil disputes between the petitioner and the 6^th respondent, it is obvious that the Writ Petition has been filed with all misleading facts to prevent the police from taking any action against the petitioner on the basis of the report lodged by the 6^th respondent. Therefore, there are absolutely no merits in the Writ Petition.

Resultantly, the Writ Petition is dismissed. No costs.

Miscellaneous petitions, if any pending, in the Writ Petition, shall stand closed.
