ORDER:

This Writ Petition is filed to declare the action of the respondents in interfering with the peaceful possession and enjoyment of the petitioner’s aquaculture tank without disposing the application No.47, dated 16.04.2013, filed by the petitioner seeking regularization of the existing tank for an extent of Ac.1.11 cents in Sy.No.608/4C of Chennuru Village, Pedana Mandal, Krishna District, as illegal and arbitrary.

When the writ petition came up for admission on 22.05.2013, an interim direction was granted restraining the respondents from demolishing the bunds.

I.A.No.1 of 2022 is filed seeking to implead respondent Nos.5 to 8, who are the neighboring land owners.

I.A.No.2 of 2022 is filed by respondent Nos.5 to 8 seeking vacation of the interim order.

Today, when the matter came up for further hearing, the learned Government Pleader submits that in view of the Andhra Pradesh State Aquaculture Development Authority Act, 2020, the petitioner needs to file fresh application.

In view of the facts and circumstances, it is open to the petitioner to file fresh application in accordance with Andhra Pradesh State Aquaculture Development Authority Act, 2020. The respondents are directed not to demolish the subject tank

for a period of four (4) weeks, from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
