Heard the learned counsel for the petitioner and the learned Government Pleader for Services-I for the respondents.

This writ petition is filed seeking for promotion to the post of Assistant Prohibition and Excise Superintendent for the panel year 20182019 along with consequential benefits.

The grievance of writ petitioner is that he is the senior most Prohibition and Excise Inspector and fully eligible and qualified for the promotion to the post of Assistant Prohibition and Excise Superintendent as per the rules. The name of the petitioner was also included in the D.P.C meeting held on 24.04.2019 for the panel year 2018-2019 but the promotion of the petitioner was deferred as the ACB (Trap) case is pending against the petitioner even though no charge memo issued and no charge sheet is filed against him.

The counsel for the petitioner submits that the petitioner made representation on 09.08.2021 to the respondent No.2 but the same is not yet disposed of.

On the other hand, the learned Government Pleader submits that the petitioner was considered for promotion by following the due procedure and the representation of the petitioner can be dealt with in accordance with law after verifying the service particulars of the petitioner only.

In view of the above said facts and circumstances, the respondent No.2 is directed to consider and dispose of the representation of the petitioner dated 09.08.2021 as expeditiously as possible strictly in accordance with law preferably within a period of three months from the date of receipt of this order.

Accordingly, this writ petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications, pending, if any, shall also stand closed.
