THE HON’BLE SRI JUSTICE R.RAGHUNANDAN RAO WRIT PETITION No.11302 of 2022

ORDER:-

The petitioner who is a resident of Pottilanka Village, Kadiam Mandal, East Godavari has approached this Court with the complaint that the 5^th respondent is seeking to demolish the bund of a tank which is existence in the said village for the past 100 years long. It is the contention of the petitioner such a demolition is illegal and arbitrary and would affect the water sources available to the residents of the village.

Sri I.Koti Reddy, learned Standing for the 5^th respondent, on instructions, submits that the 5^th respondent has not taken any steps either damaging or demolishing any part of the bund. He submits that revenue authorities had conducted a survey and that has caused the petitioner to file the present writ petition.

Recording the above statement, this writ petition is closed, directing the respondents not to damage the bund, except in accordance with law after following due procedure. It shall also be open to the petitioner to approach this Court in the event of any violation of the law or the procedure for such actions. There shall be no order as to costs.

Miscellaneous petitions, pending if any, in this Writ Petition shall stand closed.
