JUDGMENT:-
No representation for the sole appellant.
Learned counsel for the respondents is in attendance.
This Second Appeal is for hearing at the stage of admission.
The proceedings would indicate that on 30.11.2021, it was recorded that the respondents filed a memo dated 06.09.2021 intimating to the court that the appellant died on 06.09.2017 and that the appeal had abated on 30.11.2021. Learned counsel for the appellant prayed for time to take up steps to implead legal representatives of the deceased sole appellant. Despite the fact that such time was granted no such steps have been taken.
Thus at the stage of admission itself this appeal is dismissed as abated.
There shall be no order as to costs.
Miscellaneous Applications, if any, pending in this Second Appeal shall stand closed.
