Heard Mr. K. Srinivas, learned counsel for the

petitioners/accused, and learned Assistant Public Prosecutor for the 1^st respondent-State.

The present Criminal Petition is filed seeking to quash the F.I.R. No.1028 of 2021, dated 09.11.2021, on the file of Patamata Police Station, Vijayawada City, which was registered for the offences under Sections 406, 420 and 506 of I.P.C.

Learned counsel for the petitioners with reference to the grounds raised in the Criminal Petition inter-alia contended that the registration of Crime against the petitioners in the facts and circumstances is not sustainable. 4. However, in view of the prima-facie accusation made against the petitioners, this Court is not inclined to accept the same. Be that as it may, since it is submitted by learned counsel for the petitioners that the matter may be disposed of by directing the Police not to arrest the petitioners without following due process of law, this Court is inclined to dispose of the Criminal Petition providing that the Investigation Officer/Police shall follow the procedure contemplated under Section 41-A Cr.P.C. and also the guidelines issued by the Hon’ble Supreme Court in Arnesh Kumar v. State of Bihar¹ .
