ORDER:-

This Criminal Petition under Sections 482 r/w 457 of the Code of Criminal Procedure, 1973 (for short “Cr.P.C.”) is filed seeking return of the property that was seized from the possession of the petitioners in Crime No.43 of 2022 of Amruthalur Police Station, Guntur District.

Heard learned counsel for the petitioners and the learned Additional Public Prosecutor for the State.

A case under Sections 420, 272 and 273 IPC and under Section 20(2) of the COTP Act was registered against the petitioners in the above crime. On a petition filed by the petitioners under Section 482 Cr.P.C in Criminal Petition No.3168 of 2022, this Court has quashed the said F.I.R registered against the petitioners.

Therefore, the petitioners are entitled for return of the property that was seized from their possession in the above crime during the course of investigation.

Resultantly, the Criminal Petition is allowed and the Station House Officer of Amruthalur Police Station, Guntur District, is hereby directed to return the vehicle i.e., Tata Goods vehicle bearing registration No.AP 07 TE 4843 and the tobacco products seized in connection with the above crime to the petitioners on proper identification and acknowledgement.

Miscellaneous Petitions, if any pending, in this Criminal Petition, shall stand closed.
