This Criminal Petition is filed under Section 482 of the Code of

Criminal Procedure, 1973 (Cr.P.C.) to quash the proceedings in F.I.R.No.40 of 2022, dated 04.03.2022 on the file of the Station House Officer, Prathipadu Police Station, Guntur, Guntur District, against the petitioner/Accused.

Heard the counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the 1^st respondent-State.

The petitioner is the accused in the said crime. Though several grounds have been raised seeking quashing of the said F.I.R in the present Criminal Petition, at the time of arguments, the learned counsel for the petitioner confined the relief to consider disposing of the matter with a direction to the Police to follow the procedure contemplated under Section 41-A Cr.P.C.

In the light of the submission made, there is no need to go into merits of the case and this Court deems it appropriate to dispose of the Criminal Petition providing that the Investigating Officer shall follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines

issued by the Hon’ble Supreme Court in Arnesh Kumar v. State of Bihar¹ .

With the above direction, the Criminal Petition is disposed of.

As a sequel, miscellaneous applications pending if any shall

stand closed.
