Heard Mr. Dileep Kumar, learned counsel for the petitioners and also heard

Mr. V. Vinod K. Reddy, learned standing counsel for respondent Nos.4 and 5.

This writ petition (public interest litigation) is filed challenging the action of the respondent Nos.2 to 5 in undertaking the construction of Gram Sachivalayam-1 in an extent of Ac.0.07 cents forming part of Survey No.233 of Gandepalli (Village & Mandal), East Godavari District, Andhra Pradesh, which is falling on the eastern side of Sivalayam.

On the same subject matter, writ petition (public interest litigation) No.175 of 2021 was filed and on 04.09.2021, the following order was passed.

“ Heard Mr. K. Chidambaram, learned counsel for the petitioners.

A prayer is made on behalf of Mr. I. Koti Reddy, learned counsel appearing for respondent Nos.4 and 5 to take up this matter after 10 days.

The present writ petition is filed on the ground that respondent Nos.4 to 6 are undertaking construction of Grama Sachivalayam-I in an extent of Ac.0.07 cents forming part of Survey No.233 of Gandepalli Village and Mandal, East Godavari District, which is adjacent to the 7th respondenttemple on its eastern side, without there being any permission/resolution of the Grama Sabha as required under Section 6 of the Andhra Pradesh Panchayat Raj Act, 1994 and without any approval of the competent authorities.

While accommodating the prayer made on behalf of respondent Nos.5 and 6, we direct the Registry to list this case on 21.09.2021.

Till then, status quo subsisting as on today shall be maintained.

Orders as may be considered will be passed on the next date fixed, after hearing the learned counsel for the parties.”

In view of the fact that a writ petition (public interest litigation) is already pending before this Court, we are not inclined to entertain another writ petition on the same subject matter. Consequently, this petition is not entertained and the writ petition (public interest litigation) is closed.

No costs. Pending miscellaneous applications, if any, shall stand dismissed.
