ORDER:

This writ petition is filed seeking a direction to restrain the respondent Nos.3 and 4 from interfering with the peaceful possession and enjoyment of the petitioner over the suit scheduled property covered in A.S.No.1 of 2021 on the file of 2^nd respondent.

The case of the petitioner is that he belongs to Scheduled Tribe Community and respondent Nos.3 and 4 are his close relatives; petitioner made a complaint petition to the SubCollector, Rampachodavaram against respondent Nos.3 and 4 and also filed O.S.No.28 of 2020 seeking permanent injunction against the defendants therein and the said suit was dismissed; aggrieved by the same petitioner filed A.S.No.1 of 2021 before the 2^nd respondent along with CMP.No.1 of 2021 seeking temporary injunction from interference with regard to the petitioner’s peaceful possession and enjoyment of the schedule properties; but, no orders are passed by the 2^nd respondent in the said CMP; the unofficial respondents are trying to dispossess the petitioner from his subject property. Hence, the writ petition.

When the matter came up for hearing, learned counsel for the petitioner submits that the appeal filed by the petitioner before the 2^nd respondent, under Rule 47(1) of A.P.Agency Rules, 1924 against the order in O.S.No.28 of 2020, dated 08.02.2021 of the Sub Divisional Magistrate, Mobile Court, Rampachodavaram, may be directed to be disposed of.

As seen from the copy of the summons dated 16.04.2021, notice was ordered to respondent Nos.3 and 4.

Learned Government Pleader for Social Welfare submits that the appeal filed by the petitioner on 27.03.2021 will be disposed of in accordance with law.

In view of the facts and circumstances, the 2^nd respondent is directed to dispose of I.A filed in A.S.No.1 of 2021 in accordance with law as expeditiously as possible.

Accordingly, the writ petition is disposed of. No costs.

The miscellaneous petitions pending, if any, shall also

stand closed.
