The petitioner seeks writ of Mandamus declaring the action of respondents in not considering the application dated 05.11.2014 submitted by the petitioner under Section 10 of the National Commission for Minority

Educational Institutions Act, 2004 for grant of ‘No Objection Certificate/Essentiality Certificate/Recognition/Affiliation’ for establishment/confirmation and ratification of Private Unaided Self Financed Law College to the petitioner’s society as illegal, arbitrary and contrary to Article 30 (1) of the Constitution of India and for a consequential direction.

Heard Sri D. Kasim Saheb, learned counsel for the petitioner, the learned Government Pleader for Higher Education representing respondent No.1, Ms. S. Parineetha, learned Standing Counsel for respondent No.2, Sri Rambabu Koppineedi, learned Standing Counsel for respondent No.3 and Ms. Nanda, learned Standing Counsel for respondent No.4.

Learned Standing Counsel for respondent No.2 submits that since the petitioner is said to have submitted the application long back i.e., in the year 2014, if he submits a fresh application, the same will be considered and orders will be passed in accordance with law and rules expeditiously.

Learned counsel for the petitioner agreed for the same and agreed to dispose of the writ petition with a request that the application fee paid by him for the earlier application may be given credit to the application to be filed by him.

In view of the said submission, this writ petition is disposed of giving liberty to the petitioner to submit a fresh application to the respondent No.2 within two weeks from today, in which case, the respondent No.2 shall consider the same and pass appropriate orders in accordance with the governing law and rules expeditiously, but not later than four (4) weeks from the date of receipt of application from the petitioner. It is made clear that fee said to be paid by the petitioner under bankers cheque, dated 05.11.2014 shall be given credit to the fresh application to be filed by the petitioner by

the 2^nd respondent authorities. No order as to costs.

Miscellaneous Petitions pending, if any, shall stand closed in consequence.
