ORDER :-

The petitioner seeks writ of Mandamus declaring the action of the respondents in not according permission to fill up of the remaining posts sanctioned by the Government as earlier in 1971 and 1982, as illegal and arbitrary and for a consequential direction to respondents to permit the petitioner to fill up the posts as Sankrit Pandit Grade-I and Grade-II.

2. Heard Smt. K. Udaya Sri, learned counsel for the petitioner and the learned Government Pleader for School Education.

The learned counsel for the petitioner would submit that since many posts remained vacant consequent to the retirement of employees/teachers in all Oriental Schools, W.P.No.10918 of 2012 has been filed by Aided Sanskrit Schools Management Association, A.P. Markapur. This Court after hearing both the sides was pleased to grant interim direction dated 04.12.2012 as follows:

“Hence, there shall be interim direction to the effect that necessary steps be either taken, or permitted by the respondents to pave the way to fill half of the vacant posts in Sanskrit Teachers or Lecturers in the aided institutions irrespective of the strength of the students within three months from today. Filling up of the remaining half shall depend upon the work load.”

In pursuance of the orders of the Hon’ble High Court, one Grade-I (Sanskrti Pandit Grade-I) grant-in-aid post has been filled-up. The petitioner made representation to the Government on 14.02.2014 stating that still Grade-I and Grade-II Sanskrit Pandit posts are vacant and it is very difficult to get Sanskrit Pandits without proper salaries and

requested to sanction two Sanskrit posts to the institution. However, the respondents have not taken any action on the said representation.

In that view, in terms of the order, dated 04.12.2012 in W.P.M.P.No.13799 of 2012 in W.P.No.10918 of 2012 and for the reasons stated therein, this petition is disposed of with a direction to the respondents to consider the case of the petitioner institution for according permission to fill up the aided vacant posts subject to fulfillment of all other conditions governing the subject within three (3) months from the date of receipt of a copy of the order. No costs.

As a sequel, interlocutory applications, if any, pending for consideration shall stand closed.
