As regards the dispute inter se between the petitioner and the owners of the land relating to specific performance of agreement to sell said to have been executed in favour of the petitioner by the owners of the land is concerned, since the suits are pending in the civil Court, the petitioner has to pursue his remedy against the owners of the land in the said civil Court. However, as the other grievance of the writ petitioner is concerned, it is his case that the 7th respondent, who is a stranger to the said property, has been making illegal construction in the said land without obtaining prior approval of plan and as is stated that legal notices were also issued in this regard to the District Collector and the District Panchayat Officer, Anantapur, and also to 3rd and 4th respondents, to take appropriate action against the said illegal construction being carried on by the 7th respondent without obtaining prior approval of plan, this Court is of the considered view that this Writ Petition can be disposed of with a direction to the respondents to consider the said grievance of the petitioner as per legal notice issued by him and to take appropriate action in this regard according to law by fixing a time limit to that effect.
