ORDER:
The writ petition is filed under Article 226 of
Constitution of India, seeking the following relief:
“ to issue Writ Order or Direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the respondents in seizing the vehicle bearing No.AP 39 T 9302 of the petitioner without following the procedure under Statute, as illegal, arbitrary and violative of Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondents 2 and 3 to release the vehicle bearing No.AP 39 T 9302 from the custody of 3rd respondent and pass such other order or orders..”
Learned counsel for the petitioner and the learned Assistant Government Pleader for Mines and Geology submit that the issue involved in this petition is squarely covered by the order of this Court in W.P.No.671 of 2020 dated 08.01.2020.
Accordingly, the Writ Petition is disposed of in terms of the orders in W.P.No.671 of 2020, directing the respondent authorities to impose penalty in terms of Clause 16 of G.O.Ms.No.71 dated 04.09.2019, and on payment of such penalty by the petitioner, the respondents shall release the vehicles in question forthwith. No order as to costs.
Consequently, miscellaneous application, if any, shall stand closed.
