HON’BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.25902 of 2021

ORDER:

The petitioner seeks writ of mandamus declaring the action of the respondents in detaining the petitioners at 4^th semester and not allowing the petitioners to write the 4^th semester examinations and not allowing them to attend the 5^th semester classes as illegal, arbitrary and for a consequential direction to the respondents to promote the petitioners from 4^th semester to 5^th semester and conduct examinations for the petitioners to 4^th semester.

Heard learned counsel for the petitioners and Sri.M.Karri Basavaiah, learned standing counsel, representing on behalf of respondents 2 to 6 and with their consent, this writ petition is disposed of at the admission stage.

At the outset, the submission of learned counsel for petitioners is that the petitioners were unduly detained at 4^th semester and they were not allowed to attend the classes in 5^th semester, as the classes already started about 10 days back and further, the representation dated 17.09.2021, submitted by the petitioners was not so far considered.

Therefore, without expressing any opinion on the merits of the petitioners case, this Court is of the view that a direction can be given to the respondent authorities to consider the representation of the petitioners.

Accordingly, this writ petition is disposed of, directing the respondent authorities, particularly respondents 2 and 3, to consider the representation dated 17.09.2021 said to be submitted by the petitioners and after affording a personal hearing to the petitioners, pass an appropriate order in accordance with governing law and rules, within one week from the date of receipt of copy of this order. No costs.

As a sequel, interlocutory applications pending, if any, shall stand closed.
