ORDER:
The petitioner is said to have been given permission to run a telephone booth outside the premises of Sri Bheemeswaraswamy Temple, Draksharamam, in the year 1994. As the said location was required for extension of the road in front of the temple, the petitioner was relocated to a vacant site situated in front of the Southern Gopuram of the temple on 01.11.1997.
The petitioner approached this Court by way of the present writ petition, aggrieved by the notice said to have been given by the 3rd respondent allotting the place of the petitioner to the 4th respondent to run photos and toys business, by proceeding dated 30.01.2010.
This Court had, on 05.02.2010, granted an order of status quo obtaining as on that day.
The 3rd respondent had filed a counter stating that the petitioner is not available on the place, where the telephone booth was situated, and in any event, the telephone booth business itself is closed.
In view of the above submissions, this writ petition is disposed of leaving it open to the respondents to evict the petitioner, if he is still in the place mentioned in the affidavit, in accordance with law. There shall be no order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
