THE HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No.22026 of 2020
ORDER:
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking the following relief:
“….issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in counting the entitlement points at present School instead of previous Schools under rationalization, though they were promoted and posted on surplus posts in present Schools in accordance Clause-2(a) and Clause-6 in G.O.Ms.No.54, School Education (Services-II) Department, dated 12.10.2020 as illegal, arbitrary, unjust, contrary to Transfer Guidelines and also in violation of principles of natural justice guaranteed under Article 14, 16 and 21 of the Constitution of India and consequently direct the respondents to count the entitlement points from previous stations i.e., MPP School, Parisavaripalem Village and MPP School, Karlapalem and to pass such other order or orders….”

“….pleased to direct the respondents to consider the claim of the petitioners for counting entitlements points from the previous stations i.e., MPP School, Parisavaripalem Village and MPP School, Karlapalem instead of present station or continue the petitioners in the present place pending disposal of the main Writ Petition, and pass such other order or orders…”
25.11.2020 passed the following order in I.A.No.1 of 2020:
“In the circumstances, upon hearing learned counsel for the petitioners and learned Assistant Government Pleader, the 4th respondent is directed to consider and award the points, which the petitioners are entitled to, having regard to their performance of duties at the places, where they worked earlier and also the present place and for the purpose of counseling the points so obtained, shall be taken into consideration. Thus, interim order as sought, is directed.
