This writ petition is filed under Article 226 of the Constitution

of India seeking the following relief:

“to issue a writ, order or direction, particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not issuing the pattadar pass books and title deeds in favour of the petitioner in respect of the petitioner land admeasuring Ac.4.72 cents in Sy.No.174/1, situated at Madhurawada Village, Chinnagadili Mandal, Visakhapatnam District by deleting the subject land in Sy.No.174/1 from the purview of Section 22-A of the registration Act in terms of G.O.Ms.No.575, dated 16.11.2018 pursuant to the orders of this Hon’ble Court in W.P.No.4866 of 2019, dated 09.04.2019 as illegal, arbitrary, unjust and violative of Article 14 and 300-A of the Constitution of India and consequently direct the respondents to delete the subject land in Sy.No.174/1 from the purview of Section 22-A of the registration Act in terms of G.O.Ms.No.575, dated 16.11.2018 and pass”

The case of the petitioner in nutshell is that she is the absolute owner and in peaceful possession of the Ac.4.72 cents of land in Sy.No.174/1, situated at Madhurawada Village, Chinnagadili Mandal, Visakhapatnam District. She also submits that, in the year 1961 the then Vizianagaram Estate have granted land to the extent of Ac.4.72 cents in Sy.No.174 of Madhurawada Village in favour of her father Raja Panthula Raghava Rao. Subsequently, the Settlement Officer, Visakhapatnam through proceedings R.P.No.201/61 dated 06.08.1961 issued Zeroythi patta in favour one Penumatcha Satyanarayana Raju and Rajapantula Raghava Rao (father of this petitioner). The Government has directed the then Tahsildar to incorporate the same into the revenue records. But the authorities did not take any action on the said proposal. On 17.02.2002, 01.02.2006, 28.02.2007 and 10.05.2007, the petitioner have applied for pattadar pass books, but no action has been taken by the authorities.

The petitioner further submits on 16.08.2019, she made an application to the 2^nd respondent stating the above said facts and further requested to effect mutation in Revenue Records and to issue pattdar passbooks and title deeds in her favour. As the second respondent did not take any action on the representation of the petitioner, she filed the present writ petition in not issuing pattadar passbooks and title deeds in her favour.

During hearing, learned counsel for petitioner limited her request to dispose of the application/representation, dated 16.08.2019.

Learned Assistant Government Pleader for Revenue readily agreed to dispose of the said application, if any pending, in accordance with law.

Recording the submissions of the learned counsel for petitioner and the learned Assistant Government Pleader for Revenue, it would be suffice to issue direction to the respondents to dispose of representation/application dated 16.08.2019 submitted by the petitioner, if the said application/representation is in compliance of the mandatory requirement under the provisions of Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (Act No.26 of 1971) and Rules framed therein, in accordance with law, within four (04) weeks from the date of receipt of a copy of this order.

7 . With the above direction, this Writ Petition is disposed of.
