This Writ Petition is filed under Article 226 of Constitution of

India seeking the following relief:-

“….to issue an appropriate Writ, order or direction in the nature of writ of Mandamus, declaring the action of the respondents in dispossession of petitioners from their Agricultural lands admeasuring an extent of Ac. 1.31 cents out of Ac. 1.49 cents in Sy.No. 255/7B belongs to 1^st petitioner, an extent of Ac. 0.58 cents out of Ac. 1.16 cents in Sy.No. 298-3B, an extent of Ac. 0.07 cents out of Ac. 0.25 cents in Sy.No. 297-2B and an extent of Ac. 0.36 cents in Sy.No. 361-6B belongs to 2^nd petitioner situated at Agali Village Polam, Agali Mandal, Anantapur District for the purpose of widen the National Highway (NH 554-E, Kodikonda Check Post to Sira Road) without paying compensation by initiating Land Acquisition proceedings under any Act is illegal, arbitrary and violative of principles of Article 14, 21 and 300-A of Constitution of India and consequently direct the respondents forbear the above proposal of dispossession”.

Heard learned counsel for the petitioner, learned Government Pleader for Roads and Buildings appearing for the Respondents.

At the stage of admission this Court passed an order dated 06.01.2021 directed the respondents not to dispossess the petitioners from the subject land without paying compensation amount as per the Award.

Learned Government Pleader appearing for the Respondents on written instructions stated that as per the Award dated 05.02.2020, the compensation amounts were deposited in favour of the 1^st petitioner for a sum of Rs. 8,44,485/- on 06.03.2021 and Rs. 5,82,653/- on 02.03.2021 in favour of 2^nd petitioner.

Considering the submissions made by the learned Government Pleader appearing for Respondents, the Writ Petition is disposed of in view of payment made in favour of petitioners. However, the petitioners are at liberty to file application for their grievance if any before the competent authority in accordance with law.

Accordingly, this Writ Petition is disposed of. No order as to costs.

As a sequel, miscellaneous applications pending, if any, shall also stand closed.
