The Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’) by accused No.4 who is sister-in-law of the complainant, seeking to quash the proceedings in S.C.No.96 of 2020 on the file of the Assistant Sessions Judge, Ramachandrapuram, against her.

The complainant has filed I.A.Nos.3 and 4 of 2021 with prayer to compound the offences under Sections 498-A, 506, 307 read with 34 I.P.C and Sections 3 and 4 of D.P. Act, Section 67-A of Information Technology Act, 2000 read with 511 of IPC and Section 5 of Immortal Traffic (Prevention) Act, 1956 against accused No.4 in S.C.No.96 of 2020 on the file of the Assistant Sessions Judge, Ramachandrapuram and to record the compromise respectively.

The brief facts of the case are that the marriage of the complainant with A1 was solemnized on 15.05.2011 by presenting Ac.8-00 cents of land and cash of Rs.35,00,000/- as dowry. The complainant had lodged the report on 10.08.2014 on the allegation of harassment by all the accused and the same was registered as FIR No.91 of 2014 for the offences mentioned above which was numbered as S.C.96 of 2020 on the file of Assistant Sessions Judge, Ramachandrapuram and the same is pending for trial. The

present criminal petition is filed to quash the proceedings in the said sessions case on the ground of amicable settlement of the matter between the parties.

Heard Sri N.Siva Reddy, learned counsel for the petitioner/A4 and Sri Rama Murthy PVSA, learned counsel for respondent No.2/complainant.

The parties are present through online and submitted that they have compromised the matter.

The complainant submitted that with the intervention of their elders the parties have settled the matter amicably. She submitted that the maintenance and domestic violence cases filed by the complainant were also settled before Lok Adalat. Therefore, she requests that offcences may be compounded and compromise be recorded.

When this Court posed a specific question to the complainant with regard to the settlement, she submitted that her in-laws agreed to return the cash and other lanchanams which were given as dowry and that they have voluntarily agreed for compromise.

Therefore, taking into consideration the facts of the case and the joint memo filed by the parties wherein they stated that the dispute pertaining to the subject matter of S.C.No.96 of 2020 is settled before the elders and the matter was settled outside the Court and as such the complainant has no objection to compound the offence against the petitioner/A4, permission is granted to

compound the offences and compromise the matter in S.C.No.96 of 2020 on the file of Assistant Sessions Judge, Ramachandrapuram.

Accordingly I.A.Nos.3 and 4 are allowed. Consequently Criminal Petition is allowed quashing the proceedings in S.C.No.96 of 2020 on the file of Assistant Sessions Judge, Ramachandrapuram against the petitioner.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
