ORDER:

While, it is submitted by the learned counsel for the petitioners that the notice in Ref.B1/919/2019, dated 03.08.2019 has not been served on the petitioners, the learned Government Pleader for Assignment though filed copy of notice, but could not produce any plausible record that an attempt has been made by the respondents to serve notice on them. In these circumstances, this Court is unable to accept the submission of learned Government Pleader that notice was served or tried to be served on the petitioners. Therefore, service of notice cannot be accepted.

In that view of the matter, the petitioners are directed to submit their explanation to the notice in Ref.B1/919/2019, dated 03.08.2019 issued by the 5^th respondent, within two weeks from today. In which case, the 5^th respondent shall consider the same and after affording a personal hearing to the petitioners, pass an appropriate order strictly in accordance with law, within eight weeks from the date of submission of explanation by the petitioners and communicate the order to the petitioners by registered post. Till such exercise is completed, the respondents shall not take any coercive steps to dispossess the petitioners from the house site patta land in an extent of 60 sq. yards each in Plot No.123 and 73 respectively situated in

T.S.No.1983, 4A, 4B of Ward No.2, Block No.47, Dummulapeta, Kakinada, East Godavari District, issued under proceedings in Ref/B1/919/2016 dated 14.10.2017.

With the above direction, this writ petition is disposed of. No

costs.

As a sequel, interlocutory applications pending, if any, shall stand closed.
