Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue for the respondents.

At the consent of both the counsel, this writ petition is being disposed of at the stage of admission.

The contention of the petitioner in this writ petition is that though he is in possession and enjoyment of the property admeasuring Ac.0.46 cents in Sy.No.652/2, Ac.0.35 cents in Sy.No.652/4, Ac.1.25 cents in Sy.No.657/2A and Ac.0.031/2 cents in Sy.No.653/1 of Bodumalluvaripalli Village, Piler mandal, Chittoor Districrt, no assignment or patta has been granted to him. But, the 4^th respondent had issued a possession certificate, dated 23-02-2016, stating that the petitioner is in possession and enjoyment of the said property. While the matter stood thus, the 4^th respondent tried to evict him from the subject land, is the main grievance in this writ petition.

The learned Government Pleader for Revenue has fairly concedes that the petitioner is in possession and enjoyment of the said property.

This Court time and again has observed that when the petitioner is in possession and enjoyment of the property, he/she cannot be dispossessed without following due process of law. In this case also, according to the contention of the learned Government Pleader for Revenue, the petitioner is in possession and enjoyment of the property in question. In that view of the

matter, the respondents are directed not to dispossess the petitioner from the subject property except by following due process of law.

The writ petition is, accordingly, disposed of at the stage of

admission. No order as to costs.

¶13

Miscellaneous Petitions pending, if any, shall stand closed

in consequence.
