ORDER : [per Hon’ble Sri Justice M. Seetharama Murti]
This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner complaining that the learned Chief Judicial Magistrate, Guntur, is not entertaining Criminal Miscellaneous Petition filed under Section 84 of the Code of Criminal Procedure, 1973.
When the writ petition is taken up for hearing, learned counsel for the petitioner and learned standing counsel for the bank appearing for the first respondent stated that the owner of the subject property, who is the principal borrower, already filed SA.no.224 of 2019 on the file of Debts Recovery Tribunal, Visakhapatnam.
Learned counsel for the petitioner further submits that the petitioner is now intending to join in the said proceedings and, therefore, the petitioner instructed him to withdraw the writ petition reserving liberty to seek appropriate remedy, which the law permits, by approaching the Tribunal.
Having regard to the submissions, the Writ Petition is disposed of reserving liberty as sought for.
There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
