ORDER:

The petitioner seeks Writ of Mandamus declaring the action of respondents in trying to lay road across his land admeasuring Ac.0.40 cents in D.No.259 situated in Pedapalakaluru, H/o Gorlavaripalem Gram Panchayat within the limits of Guntur Municipal Corporation without following due process of law, as illegal, arbitrary and against the Article 300-A of the Constitution of India and violation of principles of natural justice and for consequential direction.

Learned Government Pleader for Municipal Administration takes notice on behalf of 1^st respondent.

Sri Kasa Jagan Mohan Reddy, learned Standing Counsel takes notice on behalf of respondent Nos.2 and 3.

Learned Government Pleader for Revenue takes notice on behalf of 4^th respondent.

Learned Standing Counsel for respondent Nos.2 and 3, on instructions, would submit that there is proposal for laying road in Pedapalakaluru, H/o Gorlavaripalem Gram Panchayat and the respondent authorities will follow due process of law in laying the said road and in case, property of the petitioner is also covered by the said road, certainly

the authorities will afford an opportunity to hear the petitioner before laying the road.

Recording the said submission of the learned Standing Counsel for respondent Nos.2 and 3, the writ petition is closed, giving liberty to the petitioner to re-agitate the same as and when the petitioner feels that his right is infringed. No order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
