ORDER:

This writ petition under Article 226 of Constitution of India is filed, questioning the action of fourth respondent in carrying out statutory responsibilities provided under Sections 23, 29(3)(a) of A.P Charitable Hindu Religious Institutions and Endowments Act, 1987 (for short A.P Act 30 of 1987) in conducting meetings of Board of Trustees, day to day affairs of third respondent temple, including policy decisions and also while conducting Brahmotsavama scheduled to be held from 02.09.2019 to 22.09.2019 and acting unilaterally, declare the same as illegal, bad, arbitrary, contrary toSections 23 and 29 (3)(a) of A.P Act 30 of 1987 and Article 14, 25 and 26 of Constitution of India, consequently direct issue direction to fourth respondent to follow procedure.

Though the petitioner raised several contentions as to disowning public duties by respondents, in fourth para of counter filed by third respondent, it is clearly admitted as follows:

I will take all the precautions in implementing Sections 23 and 29 (3)(a) of A.P Act 30 of 1987, while conducting Brahmostavams, 2019 commencing from 02.09.2019 to 22.09.2019 as was done earlier and will implement all the decisions and suggestions given by petitioner and also Trust Board Members which are reasonable and lawful.

In view of admission made in the counter, it is sufficient to issue direction to adhere to Sections 23 and 29 (3)(a) of A.P Act 30 of 1987, in conducting day to day affairs of temple, including Brahmotsavams, 2019.

Hence, writ petition is disposed of, in view of admission in fourth part of counter, with a direction to follow Sections 23 and 29(3)(a) of A.P Act 30 of 1987.
