The claimant has produced Ex.A2-the certified copy of the wound certificate, Ex.A7-the discharge summary issued by NIMS, Hyderabad and Ex.A8-Certificate-B issued by NIMS, Hyderabad with essentiality certificate along with bills. She also produced Exs.A9 & A10disability certificates issued by NIMS, Hyderabad and the Medical Board, Nandyal. In Ex.A10-disability certificate, issued by the Medical Board, Nandyal, it is mentioned that the claimant is having disability of 70%. The evidence of PW 2-Dr.K.David Raju, whom the claimant examined through an Advocate-Commissioner, establishes that she received a grievous injury to right hand. The evidence of PW 3-Dr.P.Rama Krishna, establishes amputation of right hand of the claimant. The fact is that the claimant was working as a Teacher in Kasturiba Gandhi Girijana Gurukula Vidyalayam, Mahanandi prior to the accident and was getting salary of Rs.6,000/- per month has not been disproved by the insurance company. No evidence is produced by the appellant-insurance company rebutting the testimony of PW 1 in so far as the income she was getting as a Teacher in Kasturiba Gandhi Girijana Gurukula Vidyalayam, Mahanandi. Since the claimant was aged about 30 years, applying the multiplier ‘17’ the Tribunal granted compensation of Rs.8,56,800/- under the head of “loss of earning capacity”.
