Heard learned counsel for the petitioner and Sri N.P.Singh, learned counsel for the respondent-Gorakhpur Development Authority.

The instant writ petition has been preferred for quashing the impugned second E- auction notice dated 08.12.2025 issued by the respondent nos. 2 and 3 (Annexure No. 1 to the writ petition).

Learned counsel for the petitioner submits that in most arbitrary manner the respondent-Authority has proceeded for second E-auction without disclosing any reason for cancellation of first E-auction, which is liable to be quashed by this Court.

Per contra, Sri N.P.Singh, learned counsel for the respondent-Authority vehemently contended that the first auction proceeding was cancelled by the competent authority and later on the information was uploaded over the portal. The said auction was never approved by the competent authority and even the earnest money was also returned to the petitioner. However, he prays that some breathing time may be accorded to get detailed instructions. On his request, the matter is adjourned.

Put up this matter on 27.1.2026 as fresh. Meanwhile, learned counsel for the respondent may complete his instructions. Needless to say, we have not restrained the E-auction, which is scheduled tomorrow.
