The present petition has been filed by the petitioner against the order dated 28.03.2026 passed by the Additional Commissioner-II, Devi Patan Mandal, Gonda, whereby the operation of the order dated 07.01.2026 passed in the proceedings under Section 24 of the Uttar Pradesh Revenue Code, 2006 has been stayed and the matter has been listed for hearing.

The contention of learned counsel for the petitioner is that the appeal under Section 207 of the U.P. Revenue Code, 2006 is not maintainable and the appeal would lie under sub-section (4) of Section 24 of the Uttar Pradesh Revenue Code, 2006.

In view of the aforesaid circumstances, the writ petition is disposed of with a direction to the respondent No. 1 to decide the Appeal No. 76 of 2026, Computerized Case No. C202608000000076, on the question of maintainability as well as on merits, expeditiously, preferably within a period of three months from the date of production of a certified copy of this order, after affording opportunity of hearing to all the concerned parties
